How to play this contest?

Scan your membership e-card and spend RM100 or more in a single receipt to stand a chance to win Jaya Grocer limited edition merchandise (“Contest”)

Eligibility

This Contest is organised by Trendcell Sdn. Bhd. (“Jaya Grocer”) and is open to Jaya Grocer members only (“Participants”), subject to the following terms and conditions.
This Contest is exclusively for Participants who make purchases from Jaya Grocer in-store and Jaya Grocer GrabMart only. Any purchases from Jaya Grocer webstore will not qualify for any entry.
Any transaction made outside of Malaysia will not contribute towards this Contest.

Contest period

Contest period will run from 26th August 2024, 12.00am to 30th September 2024, 11.59pm – Malaysian Time GMT+8 (“Contest Period”).
The Contest will end when the Contest Period lapsed. Any transaction made after the Contest Period shall no longer be entitled for any entries.
Jaya Grocer reserves the sole and absolute right to amend, modify, discontinue or terminate the Contest at any time prior to the expiry of the Contest Period without giving any prior notice, without being liable to any compensation in cash or in kind.

Contest rules/participation

This Contest takes place at both Jaya Grocer in-store outlets and Jaya Grocer GrabMart within the Grab App.
Participants will be automatically opted into the Contest upon scanning their membership ID and spending a minimum of RM100 in a single receipt.
Only receipt with a minimum expenditure of RM100 in a single transaction will be considered as a valid entry for the Contest (“Qualified Receipt”).
Each Qualified Receipt will be treated as a single entry.
Both delivery and pick-up orders via Jaya Grocer GrabMart are accepted for the Contest.
Jaya Grocer reserves the right to limit the numbers of Participants for the Contest, whether in-store or in Grab App.
Any order made by the Participants utilizing GrabRewards Points, GrabPromos and/or Grab subscriptions will not disqualify the Participants from this Contest.

Winners Selection / Notification:

The winners of the Contest will be announced or informed 30 days after the end of the Contest Period, i.e. first week of November 2024.
There will be a total of five hundred (500) winners, and each winner is only eligible for one (1) Rewards.
At the end of the Contest Period, winners will be randomly selected through a randomiser to win the prize.
All winners will be contacted and/or notified via a call, private message or email from Jaya Grocer, subject to the discretion of Jaya Grocer, for further instructions on how to redeem their Rewards. Winners are required to respond to the private message or email within seven (7) days of receipt. Failing which, winners may be disqualified, and Jaya Grocer reserves the right to award the Rewards to another winner.
Jaya Grocer will not be held liable in the event the winners cannot be contacted for whatever reasons.

(Hereinafter referred to as “Rewards”)

All Rewards are provided on a first-come, first-serve basis. Jaya Grocer reserves the sole and absolute right to modify or vary the total Rewards limit without any prior notice to Participants.
Each winner is only entitled to win one (1) Rewards only.
Winners are required to collect their Rewards at their preferred Jaya Grocer outlets. Delivery of Rewards is not available.
During the rewards redemption process, winners may be asked to present their membership identification, mobile number, proof of winning, identification card, or license that displays a photograph of the winner. Jaya Grocer reserves the right to forfeit the Rewards of any winner who fails to provide the required details during the redemption process.
All Rewards are strictly non-returnable, non-exchangeable, non-cumulative, non-transferable, and are not redeemable for cash or other rewards.
Winners of the Rewards understand and acknowledge that Jaya Grocer is not the manufacturer of the Rewards and has no control over the design, manufacture, or quality of the Rewards. The Rewards are provided ‘as is’ and without any warranty, express or implied. Jaya Grocer shall not be liable for any damages or losses, whether direct or indirect, arising from the use or possession of the Rewards, including but not limited to any defect or malfunction of the Rewards. Winners agree to release, indemnify and hold harmless of Jaya Grocer from any and all claims, liabilities, damages, costs and expenses, including reasonable attorneys’ fees, arising from or in connection with the receipt, use or possession of the Reward, regardless of whether such claims arise from Jaya Grocer’s negligence, breach of contract or any other cause of action.

General Terms and Conditions

By participating in this Contest, Participants acknowledged, understood and consent to be bound by these Terms and Conditions.
Participants agreed that they are in compliance with both Jaya Grocers Terms of Service & Policies, and Grab’s Terms of Service applicable for the Grab service provided, as stipulated in the Grab App/Grab-Driver App.
Jaya Grocer reserves the sole and absolute right to withdraw, amend, vary and/or alter any part of the terms and conditions in relation to this Contest, including but not limited to substitute the Rewards with other rewards of equal value, at any time without giving any prior notice to the Participants, and Participants agree to be bound by those changes.
Jaya Grocer reserves the rights, in its sole discretion, to disqualify any Participants’ participation in the Contest without cause and without notice, in particular if:
1. Participant is not an eligible or qualified Participant;
2. Participant fails to fulfill all or any of the Terms & Conditions stipulated herein;
3. Participant has engaged in a conduct that Jaya Grocer considers inappropriate or unacceptable;
4. Participant has breach any Terms & Conditions or other rules and regulations of the Contest or violates any applicable laws or regulations; and
5. any other reasons Jaya Grocer deems fit at Jaya Grocer’s sole discretion.
Participants agreed that the terms and conditions herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Contest. In the event of any inconsistency, conflict, ambiguity or discrepancy between the English version and any other languages’ version of these terms and conditions, the English version shall prevail at all times.
Participants agreed and consent that Jaya Grocer shall have the exclusive rights to use, modify, publish or display materials information submitted by Participants, including but not limited to, the names, identification numbers, mobile numbers, number of total entries, photographs, town or region of the Participants in any way it deems fit for marketing, advertising, publicity purposes and for any other reason whatsoever without any further notice to the Participants and the Participants shall not claim ownership or any payments or compensation on the materials.
Jaya Grocer’s decisions on all matters relating to the Participants shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained.
Jaya Grocer shall not be liable for any claims by the Participants or third-party claims or losses of any nature, including but not limited to, expectation loss, loss of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third-party, or other damages resulting from or in connection with this Contest.
The terms and conditions of any Rewards awarded in the form of a package/ticket/voucher shall be subject to the terms and conditions set forth in the package/ticket/voucher. In the event of any conflict between the terms and conditions of this Agreement and those of the package/ticket/voucher, the terms and conditions of the package/ticket/voucher shall prevail (if any).
All Rewards must be claimed/redeemed within the stipulated deadline (if applicable). Any Rewards not claimed by the deadline may be forfeited, or disposed, or donated, at Jaya Grocer’s discretion, and no claims whatsoever for payment or compensation shall be entertained.
By participating in the Contest, Participants consent to Jaya Grocer and Grab’s collection, use, disclosure and otherwise processing of Participants’ personal data to facilitate the conduct of the Contest (including identifying and notifying the winners, announcing the winners on Grab or Jaya Grocer’s online platforms, collection of Rewards) and for advertising, promotional, marketing and/or other related purposes without compensation, in accordance with the Personal Data Protection Act 2010 (PDPA), Grab’s Privacy Notice (https://www.grab.com/my/terms-policies/privacy-notice/) and/or Jaya Grocer’s Privacy Notice (https://info.jayagrocer.com/privacy-policy).
Participants warrant and represents that (a) Participants’ entry does not at any time infringe or violate any laws or any third party’s rights, including but not limited to privacy rights, intellectual property rights, copyright, moral rights, trademarks or business name; (b) Participants’ entry is original and have never been displayed or published in any media form, including but not limited to the internet, radio, video, television broadcast and have never been used or submitted in connection with any contest held anywhere in the world.
Participants acknowledged, understood and agreed that they are required to adhere to community standards and maintain respectful behaviour when participating in this Contest, including but not limited to refraining from sharing inappropriate, obscene, offensive, violent, false, harmful or illegal content. Jaya Grocer reserves the right to take any action, including legal action or content removal, in cases where Participants’ behaviour violates established community standards or poses a risk to Jaya Grocer’s integrity.
Participants agree that Participants shall not question the decisions of Jaya Grocer without limitations or qualification and in case of any disputes directly or indirectly arising from the Contest, all decisions of Jaya Grocer shall be final and conclusive.
These terms and conditions are governed by the laws of Malaysia and the exclusive jurisdiction of the Malaysia courts.
